Former Alabama Veterans Affairs Commissioner Files Federal Lawsuit Against Governor Ivey
MONTGOMERY, Ala. — Kent Davis, formerly the commissioner of the Alabama Department of Veterans Affairs (ADVA), has initiated a federal lawsuit against Governor Kay Ivey, alleging that his termination last year violated his constitutional rights. The suit, filed in federal court, asserts that Davis was unjustly removed from his position without lawful authority.
Davis claims that Ivey’s actions contravened both the First and Fourteenth Amendments of the U.S. Constitution, as well as state ethics laws protecting whistleblowers. He seeks remedies including reinstatement, back pay, and damages for emotional distress.
In her response, Ivey’s spokesperson, Gina Maiola, expressed confidence in the legality of the governor’s actions, stating that they are prepared to defend any legal challenges. The lawsuit contends that Ivey demonstrated “malicious” conduct in her decision, asserting that she exceeded her authority when she called for his resignation.
The controversy surrounding Davis began after he filed an ethics complaint against Kim Boswell, the Commissioner of the Alabama Department of Mental Health, who is a cabinet appointee of Ivey. The governor cited alleged mishandling of federal grant funds as the primary reason for Davis’s termination but did not reference the ethics complaint. Following public exoneration from the ADVA State Board, which formally backed Davis, Ivey accused him of violating an agreement related to his resignation, resulting in his removal last October.
Davis’s legal representation, Kenneth Mendelsohn, claims the governor’s actions were unwarranted and damaging. This lawsuit not only challenges Ivey’s authority but also sheds light on potential abuses of power in state leadership.
