A federal investigation revealed that a Texas hospital violated the law by repeatedly discharging Kyleigh Thurman, a woman suffering from a dangerous ectopic pregnancy, without providing necessary medical intervention. Thurman, 36, ultimately lost part of her reproductive system after multiple visits to the hospital and was discharged with misinformation about her condition. In April, the investigation concluded that the hospital failed to conduct a proper medical screening as mandated by the Emergency Medical Treatment and Labor Act. This law requires emergency rooms to provide stabilizing treatment to patients, and the investigation highlighted that Thurman was at risk of serious health deterioration due to her untreated ectopic pregnancy.

Following the investigation, the Trump administration announced new guidelines that may weaken the federal government’s position on emergency abortions. The Centers for Medicare and Medicaid Services (CMS) indicated it would revoke Biden-era guidance that directed hospitals, even in restrictive states, to perform abortions in emergencies. CMS administrator Dr. Mehmet Oz reassured that the law still upholds care for miscarriages and ectopic pregnancies.

However, the revocation raises concerns about enforcement and accountability for hospitals not providing necessary care. Legal experts warn that such restrictions may deter emergency personnel from administering life-saving treatments due to fear of legal consequences, reflecting a broader trend where women are denied care for life-threatening conditions in states like Texas.

Thurman expressed concern for others who might face similar situations, emphasizing the unpredictability of pregnancy complications and the urgent need for appropriate medical care in emergency settings.
