New Reporting Uncovers Alabama’s Battle Against Abortion Access

Title: Alabama’s Yellowhammer Fund Defies Criminalization of Help Amid Abortion Ban

In Alabama, the landscape of reproductive rights is shifting dramatically, with investigative journalist Nina Martin spotlighting the chilling criminalization of assistance among the state’s latest efforts to curb abortion access. Her recent pieces for Reveal and Mother Jones center on the Yellowhammer Fund, a grassroots organization that evolved from an abortion fund into a comprehensive family justice advocate, confronting the state’s threats of prosecution.

Following the 2022 Dobbs v. Jackson Women’s Health Organization decision, which triggered Alabama’s near-total abortion ban, Attorney General Steve Marshall invoked an 1896 conspiracy law, suggesting that assisting women seeking legal abortions in other states could carry penalties of up to life in prison. This legal tactic made Alabama unique in a wave of restrictive states, positioning any form of help—including arranging transportation—within legal risk.

For over a year, Yellowhammer operated under this uncertainty, scaling back its vital services until it challenged the AG’s threats in court. The case, Yellowhammer Fund v. Marshall, was heard by U.S. District Judge Myron Thompson, a long-time advocate for civil rights. In March 2024, Thompson ruled decisively in favor of Yellowhammer, asserting that the state’s logic could criminalize even benign activities like planning social events out of state.

The ruling reinvigorated Yellowhammer’s mission, leading to renewed support for nearly 50 individuals seeking assistance for out-of-state abortions in just weeks. Despite the victory, Martin warns that the fight is far from over, as similar legislative threats are emerging in states like Tennessee and Idaho.

In a context where aid can come attached with moral strings or be entirely absent, Yellowhammer’s commitment to unconditional support underscores a profound resistance to Alabama’s punitive approach. This ongoing battle not only reveals the dangers of criminalizing compassion but highlights the dedication of those who refuse to back down in defense of women’s rights.
