Kilmar Abrego Garcia’s legal team has filed a motion requesting that a federal judge in Tennessee prohibit the Trump administration from making public statements about his case. Abrego’s attorney, Sean Hecker, emphasized that Noem’s statements could jeopardize Abrego’s right to a fair trial, asserting they are irrelevant to the specific charges he faces and could prejudice the jury. He argued that the comments were calculated to harm Abrego’s reputation and influence public perception of his case. In response to these remarks, Abrego’s legal team had previously requested a retraction from the Trump administration, which went unanswered.

The court had previously ordered both the government and defense to refrain from public comments regarding Abrego’s case to maintain a fair trial environment. The current motion seeks clarification on compliance with local rules surrounding extrajudicial statements, asking the court to ensure that all officials involved in Abrego’s case adhere to these regulations.

Abrego, 29, faces federal charges related to human smuggling after his return to the U.S., which he denies, pleading not guilty to all allegations. His situation has raised significant concerns about due process and the treatment of immigrants under the Trump administration’s policies.
