Alabama Supreme Court Justice Jay Mitchell Resigns to Run for Attorney General
On Monday, Alabama Supreme Court Justice Jay Mitchell announced his resignation to pursue the Republican nomination for Alabama Attorney General in the upcoming 2026 election. This decision comes as Governor Kay Ivey prepares to announce Mitchell’s replacement within the week.
The timing is significant as today marks the first day candidates can begin fundraising for the May 19, 2026, primary election. This change follows Governor Ivey’s recent measure to shift the campaign start window to better accommodate local probate judges around the Memorial Day holiday.
Mitchell joins a growing list of potential Republican candidates eyeing the open seat, which is available due to current Attorney General Steve Marshall being term-limited after his 2018 election. Other likely contenders include Blount County District Attorney Pamela Casey, Katherine Robertson (the long-serving general counsel to Marshall), and Lloyd Peeples, an Assistant U.S. Attorney for the Northern District of Alabama.
At 48, Mitchell was first elected to the Alabama Supreme Court in 2018 and took office in January 2019. A Mobile native, he earned his undergraduate degree from Birmingham-Southern College and a law degree from the University of Virginia School of Law. Before his judicial role, he was a partner at Birmingham’s Maynard, Cooper & Gale law firm.
Mitchell’s campaign has already garnered attention, with a year-end fundraising report showing he has $654,304.40 on hand, a substantial starting point for his Attorney General campaign.
As the political landscape shifts and candidates prepare for the race, the eyes of Alabama will be closely watching the unfolding events leading up to the primary election.
