Alabama’s Stricter Vaping Regulations Near Final Approval
MONTGOMERY, Ala. — A significant legislative push in Alabama to enhance regulations on electronic vaping devices is nearing completion as the 2025 legislative session approaches its end. Sponsored by Rep. Barbara Drummond, D-Mobile, House Bill 8 aims to raise the legal purchasing age for tobacco from 19 to 21 and ban vending machines selling tobacco outside adult venues.
The bill also introduces a vaping awareness program for schools and imposes stricter penalties for minors possessing tobacco products. Retailers will face a new $150 annual permit fee and escalating fines for violations: $200 for the first offense, $750 for a second, and $1,000 for subsequent violations. Drummond emphasized the necessity of enforcement funding, which she estimates could generate around $2.5 million annually, bolstering effective regulation.
“This is my third attempt to protect our children,” Drummond stated, expressing hope for successful passage after similar legislation previously passed unanimously in the House but faltered due to competing priorities.
Although recent data shows a notable decline in youth vaping, with around 1.6 million students reported as users last year, concerns persist among educators and public officials. Some Alabama schools have turned to high-tech solutions to combat vaping on campuses.
Despite bipartisan support for House Bill 8, opposing views exist. Rep. Susan DuBose, R-Hoover, voted against it, advocating for accountability in illegal sales to minors without penalizing minors themselves. Additionally, the American Vapor Manufacturers Association opposes parts of the bill, arguing it burdens small manufacturers with stringent FDA certification requirements.
Having passed the House with a vote of 89-9, the bill is now awaiting final Senate approval before heading to Governor Kay Ivey’s desk for enactment.
