The unexpected arrest of Pavel Durov, the co-founder of messaging platform Telegram, has sparked intense scrutiny into the platform’s content moderation practices. Durov was arrested in Paris after an investigation into various criminal activities on Telegram, including organized crime, child sex abuse images, fraud, and money laundering. This arrest has raised concerns about the effectiveness of the Digital Services Act (DSA), the EU’s ambitious legislation aimed at regulating online platforms.
While the European Commission has distanced itself from the French investigation, the charges against Durov highlight the need for stronger enforcement of the DSA. Telegram, with nearly a billion users worldwide but only 41 million in the EU, has been criticized for hosting harmful content, including extremism and drug trafficking. The platform’s popularity among Russian-speaking minorities in eastern EU countries has also raised red flags.
The EU is currently evaluating whether Telegram meets the criteria to be designated as a “very large online platform” (VLOP) under the DSA. If this designation is made, Telegram would be subject to stricter regulations and supervision by the European Commission. However, enforcement of the DSA has faced challenges, with some member states, including Belgium, lacking the necessary powers to regulate platforms effectively.
Digital rights advocates are calling for greater transparency from Telegram and stricter enforcement of the DSA to protect users and combat harmful content. As the EU continues to assess the platform’s user data and potential designation as a VLOP, the future of Telegram in Europe remains uncertain.
