American companies file lawsuit to prevent Trump tariffs, argue trade imbalances are not a crisis


A group of five small businesses has sued President Donald Trump to block new tariffs imposed on foreign imports, claiming that he has overstepped Congress’ power to levy tariffs by citing trade deficits as an emergency. The businesses, represented by the Liberty Justice Center, argue that Trump’s tariffs are causing significant harm to small businesses across the country and that trade deficits do not constitute an emergency. The lawsuit challenges the Trump administration’s imposition of tariffs on countries even without a trade deficit with the United States, questioning the justification for such actions. The plaintiffs, including companies such as VOS Selections, FishUSA, Genova Pipe, MicroKits LLC, and Terry Precision Cycling, claim significant financial burdens due to the unforeseen tariffs imposed by the administration. Terry Cycling, for example, estimates facing $1.2 million in tariff costs by 2026, which they argue is unsustainable for a business of their size. The lawsuit seeks to declare Trump’s tariff power grab illegal and halt the imposition of tariffs under the International Emergency Economic Powers Act. CNBC has reached out to the White House for comment on the lawsuit.
