Alabama Implements New Vaping Regulations to Protect Youth

Montgomery, AL – Alabama has taken a significant step in combating youth vaping with the implementation of its first regulations, effective on June 1. The new law, known as HB8, aims to restrict the sale of vaping products and impose stricter penalties on businesses that violate the rules.

Under HB8, convenience stores are now limited to selling only 34 FDA-approved tobacco and menthol-flavored e-cigarette products. All other flavors, including numerous options currently under FDA review, are banned from sale except in age-restricted vape shops, which are accessible only to individuals aged 21 and over.

Additionally, the law prohibits the sale of nicotine alternatives through vending machines and stipulates that all vape products must be U.S.-manufactured. Retailers will now be required to obtain specific licenses to sell alternative nicotine products. These measures are part of a broader initiative that also mandates the State Board of Education to develop a vaping education and prevention program for schools.

Moreover, the Alabama Alcoholic Beverage Control Board (ABC) has adjusted its licensing process. Stores looking to sell tobacco and vaping products must hold a tobacco permit, now priced at $150 and renewable annually. For those wishing to sell electronic nicotine delivery systems, a specialty retailer permit costing $1,000 is required, with sales restricted to customers aged 21 and older.

The ABC plans to inform all permit holders of these changes via email, emphasizing that stores must prominently display age restriction signage. These regulations mark a crucial step in Alabama’s efforts to tackle youth vaping and promote public health within the state.
