BIRMINGHAM, Ala. – Alabama Superintendent Eric Mackey has announced the submission of a certification confirming that the state’s K-12 public schools comply with federal Title VI laws, which prohibit race-based discrimination in federally funded programs. This certification was submitted in response to a letter from the U.S. Department of Education (DOE) dated April 3, which required states to certify their compliance within ten days to avoid losing federal education funding.
Mackey, in an interview with Alabama Daily News, confirmed that the state met the April 24 deadline for submission. The DOE’s directive highlighted concerns regarding the potential misuse of Diversity, Equity, and Inclusion (DEI) programs, suggesting that such initiatives could violate Title VI if they favor one race over another, though no specific programs were identified as unlawful.
Acting Assistant Secretary for Civil Rights Craig Trainor emphasized the importance of adherence to antidiscrimination laws, stating, “Federal financial assistance is a privilege, not a right.” He noted that numerous schools have failed to uphold these legal obligations by allegedly using DEI initiatives to discriminate against certain racial groups, directly violating Title VI.
Trainor reiterated that no student should face inequity based on their race, urging all state and local educational agencies to align with these constitutional principles. As of April 25, Education Week reported that 22 states had chosen not to sign the certification, while states like Florida, Georgia, Mississippi, and Tennessee have affirmed their compliance.
