Press Release: Alabama’s CBD and THC Businesses Face Closure Due to New Legislation
Montgomery, AL – Alabama-based businesses that sell hemp-derived CBD and THC products, including gummies and flowers, may soon be forced to shut their doors if a new bill, HB445, is signed into law by Governor Kay Ivey. This legislation, passed by the state Legislature, imposes stringent regulations and taxes on hemp-related consumables, threatening the livelihoods of many business owners.
Sonya Lowery, owner of Freedom CBD & Wellness in Tuscaloosa, expressed deep concern over the potential impact: “The bill would outlaw the high-dose gummies and hemp flowers that account for 90% of my sales. It’s upsetting not just for me but especially for my customers who rely on these products for pain, anxiety, and sleep issues.” Customers have reportedly been distressed, with some in tears over uncertainty about their future access to these beneficial products.
The bill, sponsored by Representative Andy Whitt and Senator Tim Melson, aims to regulate what lawmakers describe as unregulated and dangerous products that could appeal to minors. If enacted, it would restrict sales to licensed retailers, limit sales of high-THC products, and impose a 10% retail tax along with additional state and local taxes.
Critics, including Jennifer Boozer, owner of CannaBama in Mobile, argue that such legislation will not prevent illegal sales but rather harm responsible businesses: "This law only punishes those of us trying to operate legitimately," she stated. Boozer highlighted that ethical retailers are committed to safeguarding their customers and have already implemented age restrictions.
With concerns mounting over possible job losses and the risk of pushing consumers toward the black market, business owners remain hopeful that Governor Ivey will reconsider the implications of HB445 before signing it into law.
