Last week, Immigration and Customs Enforcement (ICE) detained Denisse Parra Vargas’ three children—two U.S. citizens and one born in Mexico—in Texas, following the deportation of their mother. This situation has sparked backlash, as several children, including a child with cancer, were also expelled, raising concerns about the legal status of U.S. citizen minors in similar situations. Authorities assert that since the mothers were in the U.S. illegally, they made the decision to take their children with them, a claim families and their attorneys vehemently dispute.

Secretary Marco Rubio suggested the issue could be easily resolved since U.S. citizen children, like Denisse’s, can return if a U.S. citizen guardian is willing to bring them back. However, experts point out that logistical hurdles make this process far from simple. ICE often confiscates identification documents during deportation, complicating the return of children who may lack the necessary passports or paperwork. Families are left to navigate financial constraints and the risks involved for potential guardians traveling outside the U.S.

Critics, including Gonzalez and attorney Naiara Leite Da Silva, stress that the narrative blaming parents ignores the complex realities forcing families into these choices. The children, referred to by Leite Da Silva as “forced expatriates,” should have been given the opportunity to remain in the U.S.

Efforts are underway for humanitarian parole for the deported family members, yet the promise of reuniting U.S. citizen children with their deported parents often remains out of reach due to extended bans on reentry. The long-term impacts on U.S. citizen children, including education and health care access in their parents’ countries, highlight the severe consequences of such deportations, raising questions about the appropriateness of these actions.
