ACLU takes legal action against Trump administration to stop immigrant transfers to Guantanamo

Immigrant rights groups have sued the Trump administration to stop the transfer of migrants from the U.S. to Guantanamo Bay. The lawsuit, filed by multiple legal advocacy groups including the American Civil Liberties Union, represents 10 individuals in immigration custody, including nationals from Venezuela, Afghanistan, Pakistan, and Bangladesh. The suit argues that transferring these individuals to Guantanamo violates federal law and the U.S. Constitution. The groups emphasize that there is no legitimate reason for such transfers, as the government has ample detention capacity within the U.S. and detaining migrants in Guantanamo is illegal and unprecedented.

The lead counsel in the case, Lee Gelernt, criticized the move as “theatrics” and expressed concerns about the logistical complications and additional costs associated with transferring migrants to Guantanamo. The ACLU has revealed that some migrants have been threatened with transfer to Guantanamo, despite not being gang members or high-risk criminal aliens. The lawsuit also highlights the government’s refusal to provide notice of transfers, creating uncertainty and fear among detainees and their families.

In response to the lawsuit, the Trump administration disclosed that 178 Venezuelan migrants had been detained at Guantanamo, with the detainees either deported or returned to detention in the U.S. Advocates argue that detaining immigrants in foreign countries, such as Guantanamo, is unlawful and a waste of taxpayer money. The lawsuit seeks to prevent further transfers to Guantanamo and ensure that migrants in immigration custody are not subjected to inhumane conditions.
